Assicuriamo la ricezione, gestione, analisi e trattamento delle segnalazioni, anche anonime, in osservanza di quanto previsto dalla Direttiva (UE) 2019/1937 e dalla relativa legge di recepimento, il D.lgs. 24/2023.

Definizione

Con l’espressione “Whistleblower” si fa riferimento al soggetto che segnala violazioni, irregolarità o illeciti commessi ai danni dell’interesse pubblico e aziendale agli organi legittimati ad intervenire.

Nello specifico, le violazioni che possono essere segnalate ai sensi del D.lgs. 24/2023, c.d. “Decreto Whistleblowing” devono avere ad oggetto comportamenti, atti od omissioni che ledono l’interesse pubblico o l’integrità dell’azienda, di cui il Segnalante sia venuto a conoscenza nel contesto lavorativo, ai sensi dell’art. 3, co. 2, lett. a), ovvero:

  • violazioni del diritto dell’UE (es. sicurezza dei trasporti; tutela dell'ambiente; protezione dei consumatori; tutela della vita privata e protezione dei dati personali e sicurezza delle reti e dei sistemi informativi; ecc).

La segnalazione (cd. “Whistleblowing”), in tale ottica, è un atto di manifestazione di senso civico, attraverso cui il Whistleblower contribuisce all’emersione e alla prevenzione di rischi e situazioni pregiudizievoli.

Scopo

Lo scopo principale del Whistleblowing è quello di prevenire o risolvere un problema internamente e tempestivamente.

È garantita la massima riservatezza sui soggetti e sui fatti segnalati, nonché sull’identità dei segnalanti, affinché chi effettua la segnalazione non sia soggetto ad alcuna forma di ritorsione.

Modalità

Le segnalazioni possono essere inviate attraverso una apposita Piattaforma – idonea a garantire, con modalità informatiche, la riservatezza dell'identità del segnalante – disponibile al seguente link:

Tale canale è considerato preferenziale e idoneo a garantire, con modalità informatiche, la riservatezza dell'identità del segnalante.

Le segnalazioni saranno gestite dalla Società Soluzioni srls, che mette a disposizioni personale e professionisti dotati di autonomia e specificatamente formati alla gestione delle segnalazioni.

Si ricorda che, in alternativa, è possibile inviare la segnalazione anche attraverso i seguenti canali:

  • Inviando segnalazione o richiedendo un appuntamento presso la sede aziendale in via 1° Maggio 50, Ancona (AN)

Fermo l’utilizzo preferenziale dei canali di segnalazione messi a disposizione, nei casi tassativamente indicati ai sensi dell’art. 6 del D.lgs. 24 del 10 marzo 2023, è possibile effettuare segnalazione anche all’autorità competente in materia (ANAC).
